Rideshare Accidents

WHEN DO UBER AND LYFT COVER RIDESHARE ACCIDENT DAMAGES?

Uber and Lyft’s insurance policies tend to kick in when the at-fault driver’s insurance policy does not cover your accident-related damages. This coverage is only activated in specific situations.

Uber and Lyft’s insurance policies will usually cover accident-related damages (where other applicable policies do not) if a ride is in progress and at least one passenger is in the rideshare vehicle. Their policies may also be in force when a driver has paired with a passenger and is en route to pick them up. Uber/Lyft insurance may potentially be used if a driver is logged into the app, though the driver’s personal auto insurance will likely need to be leveraged first. If the driver is offline, Uber or Lyft insurance coverage cannot be used.

To protect yourself after a rideshare accident (whether you are a passenger or driver), be sure to save evidence of your rideshare status at the time of the crash. That means you should save a record of a trip in progress or, if you are a driver, your being online on a rideshare app or en route to pick up a passenger.

WHAT IF UBER OR LYFT REFUSES TO PAY FOR MY MEDICAL BILLS AND OTHER EXPENSES?

Even if the circumstances of your accident should trigger coverage under Uber or Lyft’s insurance policies, they may attempt to deny your claim by claiming they are not responsible for your losses. Alternatively, they could offer an unacceptably low settlement. In either instance, cease contact, do not accept any money, do not sign any contract, and get in touch with Bell Legal Group. We can evaluate your situation, ascertain liability, and walk you through your legal options. Remember, the insurance companies are never on your side, but we can help you level the playing field and get you the compensation you are entitled to under the law.

WHAT DAMAGES CAN I RECOVER IN A RIDESHARE ACCIDENT LAWSUIT?

If necessary, we are more than ready to go to court to get you what you deserve. We are never afraid of a trial, no matter the complexity of the case. To protect your right to recover damages, you must start the legal process before the statute of limitations expires. In South Carolina, you have three years from the date of the rideshare accident to file a personal injury claim. You will only have two years to pursue a claim if the defendant is a government entity.

Our South Carolina rideshare accident lawyers will fight to get you just compensation for all economic and non-economic losses, including:

  • Medical expenses
  • Lost income
  • Lost earning potential
  • Property damage
  • Pain and suffering
  • Loss of consortium
  • Loss of enjoyment of life
