Camp Lejeune Litigation Update: Track 1 Bellwether Trial Cases Released

The long-awaited Track 1 Bellwether Plaintiffs for the Camp Lejeune Water Litigation Case, Case No. 7:23-cv-897, were released on December 5, 2023, by the United States District Court for the Eastern District of North Carolina.

In October of 2023, all four federal judges presiding over the litigation separated the case into tracks, per disease. Track 1 includes individuals diagnosed with Parkinson’s Disease, Kidney Cancer, Bladder Cancer, Leukemia and Non-Hodgkin’s Lymphoma. The judges also noted in their October order that the parties should be prepared to commence trials in 2024.

The Track1 cases include a total of 100 claimants, comprised of 10 selections by plaintiff’s leadership and 10 selections by the defendant, per each of the diseases.

The Track 1 bellwether cases will play a pivotal role in shaping the litigation landscape by providing a representative sample of claims to the larger pool of lawsuits.

The outcomes of these cases will ultimately contribute to the resolution process for the individuals impacted by the contaminated water at Camp Lejeune.

The court has not yet determined which diseases will be included in Tracks 2 and 3.
