Camp Lejeune Litigation Update: Track 2 Illnesses Released

The Court’s selection for Track 2 illnesses for the Camp Lejeune Water Litigation Case, Case No. 7:23-cv-897, was released on February 26, 2024, by the United States District Court for the Eastern District of North Carolina.

The Camp Lejeune litigation was previously separated into tracks, per illness, to help expedite proceedings. The Court’s selection of Track 1 illnesses was announced in December 2023, and  100 Track 1 Discovery Pool Plaintiffs were selected to proceed. 

The Court has stated Track 2 illnesses shall include prostate cancer, kidney disease, lung cancer, liver cancer, or breast cancer. The Court notes that this selection does not assess the merits of these or other Camp Lejeune Justice Act actions—the focus is on common illnesses for which early trials may help to promote early resolutions.

The parties were ordered to submit, jointly or separately, a proposed discovery plan for the Track 2 Illnesses within 10 days of this order.
