An Order was issued by all four Camp Lejeune Judges on July 9, 2024, confirming which Plaintiffs will proceed to the first bellwether trials.
As established in an earlier Case Management Orders, the illnesses for Track 1 include bladder cancer, kidney cancer, leukemia, Parkinson’s disease, and non-Hodgkin’s Lymphoma. The final list of Track 1 Trial Plaintiffs includes five individuals for each illness, three proposed by the PLG and two by the Defense.
This Order also established upcoming deadlines and rules for the next phase of the litigation:
- The selected plaintiffs must amend their Short Form Complaints within 10 days to remove waived illnesses or injuries beyond the scope of Track 1.
- The fact discovery for Track 1 Trial Plaintiffs, including general discovery, shall conclude on August 11, 2024.
- The deadlines and discovery for all Track 1 Discovery Pool Plaintiffs not selected in this final group of Plaintiffs are stayed.
Everyone harmed by the contaminants in the water at Camp Lejeune, whether they are experiencing a Track 1 Illness or other disease, look forward to the commencement of these proceedings. The first Trial Plaintiffs will set a precedent for the relief countless people are seeking and hopefully open the doors to expedite future cases.
