Order for Camp Lejeune Track 1 Plaintiff Selection

The Court overseeing the Camp Lejeune Water Litigation entered an important Order this week regarding guidelines for selecting Track 1 Trial Plaintiffs, (Case Management Order No. 12) — Order Regarding Track 1 Trial Plaintiff Selection Protocol.

This is a meaningful moment for anyone awaiting the resolution of the Camp Lejeune lawsuit. This Order directs the parties to select Track 1 Trial Plaintiffs from Track 1 Discovery Pool Plaintiffs who allege only one Track 1 illness (or multiple Track 1 illnesses) were caused by the water at Camp Lejeune. The five Track 1 illnesses are kidney cancer, bladder cancer, leukemia, Non-Hodgkin’s lymphoma, and Parkinson’s disease.

The Order specifically directs:

  • Plaintiffs’ Leadership Group (PLG) to propose to the Court three plaintiffs from the Trial Plaintiff Pool for each of the five Track 1 illnesses to proceed to trial.
  • Within five days of the PLG submission, the Defendant shall submit to the PLG two plaintiffs from the Trial Plaintiff Pool for each of the five Track 1 illnesses to proceed to trial.

When the process concludes, the plaintiffs selected by the Parties will be confirmed by the Court and designated as Track 1 Trial Plaintiffs.

This Order marks an important step forward for all affected by the contaminated water at Camp Lejeune.
